Share-Me for Event Stamp Rally Terms of Use

These Terms of Use (hereinafter referred to as "these Terms") define the conditions for using the "Share-Me for Event" stamp rally service for events (hereinafter referred to as "this Service") provided by Share-Me Inc. (hereinafter referred to as "the Company").

Attendees (hereinafter referred to as "Users") who use this Service shall confirm and agree to the content of these Terms before using this Service.

Article 1 (Content of this Service)

  1. This Service is a service that records Users' visits to booths, exhibitions, lectures, plans, and other designated locations using NFC stands, QR codes, and other media installed at event venues, and provides stamps, points, benefits, and other event participation experiences.

  2. This Service includes all or part of the following functions:

    1. Stamp acquisition function via NFC stand or QR code scanning

    2. Function to display stamp acquisition status, visit history, and achievement status

    3. Function to view information about exhibitors, booths, products, services, materials, etc.

    4. User action functions such as surveys, material requests, inquiries, meeting requests, contact sharing, etc.

    5. Campaign participation functions such as benefits, lotteries, coupons, prizes, etc.

    6. Functions incidental to each of the preceding items

  3. This Service does not inherently include admission management functions such as event admission reception, ticket sales, identity verification, payment, or seat management. If these functions are provided separately, separate terms and conditions will apply.

Article 2 (Application of these Terms)

  1. These Terms apply to all Users of this Service.

  2. For each event, the event organizer, operator, venue manager, and other related parties (hereinafter collectively referred to as "Organizer") may specify event participation conditions, venue usage rules, benefit conditions, campaign conditions, and other individual conditions.

  3. In the event of a conflict between these Terms and the individual event conditions, the individual event conditions shall take precedence for matters related to the operation, benefits, campaigns, and other event-specific matters. However, these Terms shall apply to the conditions for using this Service itself.

Article 3 (Roles of the Company, Organizer, and Exhibitors)

  1. The Company provides the system, management functions, data acquisition and display functions, and other related functions of this Service.

  2. The Organizer is responsible for event planning, operation, exhibitor management, venue management, campaign design, benefit provision, and other matters related to event operation.

  3. Companies, organizations, and other businesses exhibiting at the event (hereinafter referred to as "Exhibitors") are responsible for their respective booths, exhibits, materials, product/service descriptions, inquiry handling, meeting arrangements, and other content provided by them.

  4. User information acquired through this Service may be shared between the Company, the Organizer, and Exhibitors. The specific handling shall comply with the Company's separately established Privacy Policy and the displays on this Service.

Article 4 (User Registration and Information Entry)

  1. When using this Service, Users may be required to enter information such as their name, email address, company name, job title, industry, areas of interest, and other information designated by the Company or the Organizer.

  2. Users shall guarantee that the entered information is accurate and up-to-date.

  3. If the entered information contains false or inaccurate content, impersonation of a third party, or other inappropriate content, the Company or the Organizer may restrict the use of this Service and invalidate the acquisition of stamps, points, benefits, or other entitlements.

Article 5 (Stamp Acquisition and Visit History)

  1. Users can acquire stamps by using NFC stands, QR codes, or other methods designated by the Company or the Organizer installed at the event venue.

  2. Stamp acquisition may require a smartphone, communication environment, browser, device settings, and other usage environments.

  3. User actions such as NFC taps, QR code scans, booth viewing, material viewing, stamp acquisition, and others may be recorded for visit history, participation status, benefit determination, event analysis, reporting to exhibitors, service improvement, and fraud prevention.

  4. Stamps may not be acquired normally due to communication environment issues, device settings, browser specifications, NFC reading failures, QR code reading failures, or other reasons.

Article 6 (Information Sharing with Exhibitors)

  1. In this Service, Users' registration information, stamp acquisition status, booth visit history, browsing history, survey responses, material requests, inquiries, meeting requests, contact sharing, and other information may be shared with the Organizer, the Company, and relevant Exhibitors.

  2. The scope of information shared with Exhibitors varies depending on the event-specific settings, displays on this Service, User actions, and consent.

  3. If a User performs an NFC tap, QR code scan, views materials, answers a survey, requests materials, requests a meeting, shares contacts, or performs other actions at a specific booth, the User's information may be provided to the Exhibitor of that booth.

  4. By using this Service, Users understand and agree that their information may be shared with the Organizer, the Company, and Exhibitors according to each action.

Article 7 (Benefits, Prizes, and Campaigns)

  1. The content, conditions, eligible participants, quantity, provision timing, provision method, and other matters related to stamp rallies, lotteries, benefits, prizes, coupons, and other campaigns shall be determined by the Organizer or Exhibitors.

  2. The Company shall not be responsible for the content, quality, availability, usage conditions, or other aspects of benefits, etc., except when the Company itself provides them.

  3. Acquired stamps, points, benefits, and other rights may be invalidated if any of the following apply:

    1. If stamps or benefits are acquired through fraudulent means.

    2. If registered information contains false or inaccurate content.

    3. If multiple registrations by the same individual or other fraudulent use is confirmed.

    4. If there is a violation of individual event conditions or these Terms.

    5. If the Company or the Organizer reasonably determines it to be inappropriate for any other reason.

Article 8 (Prohibited Acts)

Users shall not perform the following acts when using this Service:

  1. Acts that violate laws, public order and morals, or these Terms.

  2. Acts of registering false information.

  3. Acts of using this Service by impersonating a third party.

  4. Acts of illegally using, duplicating, altering, or disseminating NFC stands, QR codes, URLs, stamp acquisition functions, or other related items.

  5. Acts of using this Service in a manner that exceeds normal usage, such as automated tools, bots, or scraping.

  6. Acts that infringe upon the rights, interests, reputation, or privacy of this Service, the Company, the Organizer, Exhibitors, or third parties.

  7. Acts of unauthorized access to or imposing excessive load on the system of this Service.

  8. Acts that hinder event operation, booth operation, or the participation experience of other attendees.

  9. Other acts that the Company or the Organizer reasonably deems inappropriate.

Article 9 (Usage Restrictions)

  1. If a User violates these Terms or is suspected of fraudulent use, the Company or the Organizer may, without prior notice, suspend the use of this Service, cancel registration, invalidate stamps, points, benefits, and take other necessary measures.

  2. Even if a User suffers damage due to the measures taken in the preceding paragraph, the Company shall not be liable unless there is willful misconduct or gross negligence on the part of the Company.

Article 10 (Intellectual Property Rights)

  1. Intellectual property rights related to this Service, the screens, designs, logos, programs, texts, images, videos, materials, and other content on this Service belong to the Company, the Organizer, Exhibitors, or legitimate rights holders.

  2. Users shall not reproduce, reprint, distribute, modify, publicly transmit, sell, or otherwise use these contents beyond the scope necessary for using this Service.

Article 11 (Modification, Suspension, and Termination of this Service)

  1. The Company may modify, suspend, or terminate all or part of this Service when necessary due to system maintenance, fault handling, specification changes, cancellation/postponement/change of events, communication failures, natural disasters, cyber attacks, or other reasons.

  2. Even if a User suffers damage due to the preceding paragraph, the Company shall not be liable unless there is willful misconduct or gross negligence on the part of the Company.

Article 12 (Disclaimer of Warranty)

  1. The Company does not guarantee the accuracy, completeness, usefulness, continuity, suitability for a specific purpose, absence of defects, or that Users will obtain the expected results regarding this Service.

  2. The Company does not guarantee the accuracy, quality, safety, or legality of information, materials, products, services, benefits, or other content provided by Exhibitors or the Organizer.

Article 13 (Limitation of Liability)

  1. If the Company causes damage to a User in connection with this Service, the Company shall be liable only for ordinary and direct damages, except in cases of willful misconduct or gross negligence on the part of the Company.

  2. The Company shall not be liable for information provision, communication, solicitation, negotiations, benefit provision, product/service provision, or other actions by the Organizer or Exhibitors, except in cases of willful misconduct or gross negligence on the part of the Company.

  3. The provisions of the preceding two paragraphs shall not apply to the extent that limitations are not permitted under the Consumer Contract Act or other applicable laws.

Article 14 (Handling of Personal Information)

The Company's handling of Users' personal information, stamp acquisition history, booth visit history, browsing history, and other information shall comply with the "Share-Me for Event Stamp Rally Privacy Policy" separately established by the Company.

Article 15 (Modification of These Terms)

  1. The Company may change these Terms due to changes in laws and regulations, changes in the content of this Service, or other necessities.

  2. When changing these Terms, the Company will notify Users of the modified content and effective date through display on this Service, email, or other appropriate methods.

  3. If a User uses this Service after the effective date of the changes, the User shall be deemed to have agreed to the modified Terms. However, for changes that require User consent under law, the Company will obtain consent separately.

Article 16 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by and construed in accordance with the laws of Japan.

  2. Any disputes arising between the Company and Users regarding this Service or these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court or the Tokyo Summary Court as the court of first instance, unless otherwise provided by law.
